We reserve the right to amend these Terms from time to time so please review them each time before you use this Website. If we amend these Terms, we will post the revised version here, with an updated revision date. If we make material changes to these Terms, we will post a prominent notice on our Website.

All information provided by us under these Terms is provided in good faith.  Unless expressly stated otherwise, you accept that any information provided by us is general information about the industry, our products and services and is not in the nature of advice. We derive our information from sources that we believe to be accurate and up to date as at the date of publication. We nevertheless reserve the right to update this information from time to time.

While we strive to ensure that the information on our Website is accurate, we do not make any representations or warranties that the information we provide on our Website is reliable, accurate, current, or complete or that your access to that information will be uninterrupted, timely or secure.

You should make your own enquiries and seek advice before acting or relying on information or material which is made available to you.

MEMBERSHIP

If your company wishes to become a member of FGC, it will be required to apply.  Its registration as a member is subject to the terms from time to time set out in our Constitution and Rules.

Once the application has been approved, employees of the company will be able to access the members’ section of the website by selecting a username and password for their account. As an employee, it is your responsibility to ensure your email address and any other information you provide is (and remains) valid and up-to-date.

You must keep your username and password confidential and secure. You remain responsible for all use of, and activity associated with, your username, password and account (whether such use or activity is authorised by you or not). If you believe that your username or password has been lost or stolen, or if you believe that your account has been hacked or accessed by someone not authorised by you, you must contact us immediately and you should, if possible, immediately reset your password.

DISCLAIMER

We do not accept responsibility for any loss, damage, any consequential indirect or special damage or loss of any kind whatsoever, however caused (including through negligence), which you many directly or indirectly suffer in connection with your use of our Website or any link or any other website.

To the extent permitted by law, any condition or warranty which would otherwise be implied into these Terms is hereby excluded.

Exceptions for disclaimer

The disclaimer set out in these Terms does not attempt or purport to exclude liability arising under statute if, and to the extent, such liability cannot be lawfully excluded.

If you are using this Website as a ‘consumer’ within the meaning of the Fair Trading Act 1986, then we acknowledge that the Disclaimer does not apply to you.

Nothing in the Disclaimer is intended to exclude, restrict or modify a consumer’s rights under the Consumer Guarantees Act 1993.

SPECIFIC WARNINGS

You must ensure that your access to this Website is not illegal or prohibited by laws which apply to you. PRIVACY AND YOUR DATA

We may collect personal information provided by you on this site (Personal Information), particularly in relation to membership registration, event registration for events, and from inquiries.

We may from time to time collect additional information about you on this Website. For example, we analyse non-identifiable web traffic data to improve our services. We own the data that is generated and it will not be shared with any other party for any other purpose.

We may collect, hold, and use statistical information about visits to help us improve the site, for instance:

  • Your IP address
  • The search terms you used
  • The pages accessed on our site and the links you clicked on
  • The date and time you visited the site
  • The referring site (if any) through which you clicked through to this site
  • Your operating system (eg Windows XP, Mac OS X)
  • The type of web browser you use (eg Internet Explorer, Mozilla Firefox)

The data collected is aggregated and is not personally identifiable. IP addresses are masked so that they cannot be used to identify individuals. Our web analytics will also respect any “do not track” setting you might have set on your browser.

All Personal Information will be used only for the following purposes:

  • to provide FGC products and services to you, as requested by you
  • to enhance those products and services
  • to contact you regarding your attendance at our events
  • to contact you for post-event surveys and information updates.

Where we use a third-party provider, such as S2N for events, any personal information you provide (e.g. name, organisation, email addresses, phone number, billing address, delegate medical information (physical disabilities, medical conditions, medication to be taken on the trip, special dietary requirements, emergency contact numbers) will be encrypted and securely forwarded to that third-party provider for storage in accordance with its privacy policy.

As required by the Privacy Act 1993, we follow strict security procedures in the storage and security of information which you have given us to prevent unauthorised access.

Our security procedures mean that we may occasionally request proof of identity before we are able to disclose sensitive information to you.

You may:

  • access your Personal Information;
  • request correction of your Personal Information;
  • request that your Personal Information be transferred to another business of your choice;
  • request your Personal Information be erased
  • request restrictions on processing of your Personal Information; and
  • object to processing of your Personal Information
  • withdraw consent to use of your Personal Information

SECURITY OF INFORMATION

Unfortunately, no data transmission over the internet can be guaranteed as totally secure. While we strive to protect such information, we do not warrant and cannot ensure the security of any information that you transmit to us. Accordingly, any information that you transmit to us is transmitted at your own risk. Nevertheless, once we receive your transmission, we will take reasonable steps to preserve the security of such information. You should never share your secure information, password or identifier with any other person.

COOKIES AND ANALYTICS TOOLS

We use cookies and analytics tools on our Website for session authentication purposes and to collect anonymous information about how you use the Website. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your web browser (if you allow) that enables the sites’ or service providers’ systems to recognize your browser and capture and remember certain information.

First-party cookies are used for Member login/authentication, form validation and choosing to bypass the old web browser warning (should you be using an old unsupported web browser). EVENTS

Online credit card payment for small events

Credit card payment is available online in real time for small events. You will be informed immediately if your credit card is declined. If declined, you should check the accuracy of the credit card number and expiration date or choose a different card to try.

Credit card payments will be taken via secure hosted systems from Direct Payment Solution (DPS) / Payment Express. Credit card details will NOT be retained by the Website. Your registration will be recorded immediately once you complete your online payment.

Refund policy for small events

We require five clear working days’ notice of a cancellation to approve a refund, less a 10% administration fee. If you are unable to give such notice, we would be happy for you to arrange for another person to attend on the day. Unless such notice is given within this timeframe, full fees are payable, and refunds will not be given.

Registrations that are cancelled with less than five working days’ notice will not be eligible for a transfer to another date, or refund.  Should an event fail to attract a minimum number of participants, we reserve the right to cancel it.

NOTE: Big events like the Annual and Half Yearly Conference may be subject to their own terms and conditions and the terms and conditions of a third-party event provider.

JURISDICTION AND APPLICABLE LAWS

These Terms of Use are subject to the laws of New Zealand, and the users of this Website submit to the exclusive jurisdiction of the New Zealand courts. In these Terms, unless the context indicates otherwise, references to any statutory provision are to statutory provisions in force in New Zealand and include any statutory provision which amends or replaces it, and any bylaw, regulation, order, statutory instrument, determination or subordinate legislation made under it.
